ORDINANCE NO. 227

 

An Ordinance amending the Code of Ordinances of the City of 

Walford, Iowa, by amending Chapter 145 and adding 

Section 145.09 and 145.10 pertaining to Dangerous Buildings 

 

BE IT ENACTED by the City Council of the City of Walford, Iowa:

 

SECTION 1.   NEW SECTIONS. The Code of Ordinances of the City of Walford,Iowa, is amended by adding the following, which is hereby adopted to read as follows:

 

145.09 CODES ADOPTED. Except as hereinafter added to, deleted, modified or amended, there are hereby adopted as the Property Maintenance Code of the City of Walford those certain Codes and Regulations as codified in the Linn County Iowa Code of Ordinances, Chapter 105 – Buildings and Building Regulations, Articles VI, including all future amendments and modifications thereto. The provisions of said property maintenance code shall be controlling in regulating the conditions and maintenance of commercial structures and premises that are located in B-1 Commercial District zoning, all rental properties and properties that have been Abandoned as per the Walford Code of Ordinances Chapter 145.03 (5), and in ensuring that structures are safe, sanitary, and fit for occupation and use. The provisions of said property maintenance code within the jurisdictional limits of the city and shall be known as the "city property maintenance regulations."

145.10 BOARD OF APPEALS. In order to hear and decide appeals of orders, decisions or determinations made by the Code Official relative to the application and interpretation of the city property maintenance regulations, there shall be and is hereby created a Board of Appeals. The City Council is hereby designated as the Board of Appeals. The Code Official or designated representative shall be an ex-officio member without a vote.

The Board of Appeals shall adopt reasonable rules and regulations for conducting its investigations and shall render all decisions and findings in writing to the Code Official with a duplicate copy to the appellant and may recommend such new legislation as is consistent therewith. 

A nominal appeal fee to the Board of Appeals shall be paid as adopted by resolution of the City Council. If granted, the appeal shall be valid for one (1) year from the date of the Board approval to the commencement of work and to the completion of work undertaken pursuant to the approval.

The Board shall have no authority of interpretation of the administration of these regulations, nor shall such board be empowered to waive requirements of these regulations.

SECTION 2.  SEVERABILITY CLAUSE. If any section, provision, or part of this ordinance shall be adjudged invalid or unconstitutional, such adjudication shall not affect the validity of the Ordinance as a whole or any section, provision or part thereof not adjudged invalid or unconstitutional.

 

SECTION 3.  WHEN EFFECTIVE.  This Ordinance shall be in effect from and after its final passage, approval and publication as provided by law.
